These Terms of Purchase (“Terms of Purchase”) govern your purchase of products and services available on the website https://www.smirksa.com (“Company Sites” or “Sites”). The Company Sites are operated by smirksa.com (“Company”). Your use of the Company Sites and these terms are also governed by the Terms of Use and Privacy Policy, which are incorporated into these Terms of Purchase.
PLEASE READ THESE TERMS OF PURCHASE CAREFULLY, ALONG WITH THE TERMS OF USE, PRIVACY POLICY, AND ANY OTHER POLICIES OR AGREEMENTS REFERENCED HEREIN, BEFORE MAKING A PURCHASE OR USING PRODUCTS OR SERVICES THROUGH THE COMPANY SITES. BY MAKING A PURCHASE OR USING PRODUCTS OR SERVICES THROUGH THE COMPANY SITES, YOU AGREE TO THESE TERMS OF PURCHASE, INCLUDING WITHOUT LIMITATION, THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER DESCRIBED IN THE DISPUTE RESOLUTION SECTION.

These Terms of Purchase constitute a valid and binding agreement between you and the Company, enforceable according to their terms. You represent that:

(2) you have the legal capacity to enter into a binding agreement, and
(3) you are not prohibited from using services under any applicable laws, rules, or regulations.
You agree to purchase and use the products and services available on the Company Sites in accordance with these Terms of Purchase and all applicable laws (“Law”). You are responsible for complying with all applicable laws related to your purchase, including laws applicable in the destination country. All phone calls, emails, and other communications between you and the Company may be recorded.

You agree to the collection, storage, and processing of all personal data you provide to the Company (via the Sites, email, phone, or otherwise) in accordance with the Privacy Policy. The Company may update its Privacy Policy at its sole discretion. All changes will be posted on https://www.smirksa.com. Continued use of the Sites after such changes signifies your acceptance.
PURCHASES
Order Fulfillment
The Company reserves the right, at its sole discretion, to decline or cancel your order under certain circumstances, such as product unavailability, pricing errors, suspected fraud, or for any other legitimate reason. The Company also reserves the right to verify your identity before fulfilling an order. You will not be charged or will receive a refund if your order is not processed. The Company further reserves the right to:
(i) withdraw any offer,
(ii) correct errors, inaccuracies, or omissions, and
(iii) modify prices, content, promotions, product descriptions, specifications, and other information without prior notice (even after your order has been submitted or accepted, shipped, or received—unless prohibited by law).
Product and Service Descriptions

However, it does not guarantee that descriptions are accurate, complete, reliable, current, or error-free. If a product or service is not as described, your sole remedy is to return the item in accordance with these Terms of Purchase.
The Sites may offer a “quick view” feature allowing users to preview prices and add items to the cart without opening the detailed product page. This feature is for convenience only; full product details, including origin, features, and pricing, are listed on the main product page.
Pricing Information
The Company strives to ensure that all pricing information is accurate. However, errors may occur. The Company reserves the right, at its sole discretion, not to fulfill or to cancel any order if a product or service is listed at an incorrect price. In such a case, you will be notified via email. The Company also reserves the right to correct pricing errors at any time.
Product and Service Availability
The Sites may include information about product availability to help estimate whether an item can be shipped promptly after placing an order. The estimated delivery time to your address is approximately 30 days or less after successful payment. This may vary due to stock shortages, weather, transit time, delivery address, etc. The Company cannot guarantee immediate dispatch of items marked “in stock” as inventory can change rapidly. Occasionally, a product may be in stock at the time of order but unavailable at the time of fulfillment. You will be notified by email in such cases. Out-of-stock items are typically removed from sale. If the Company determines a product or service is no longer available, it will be canceled from the order and you will be notified via email.

(a) may not include manufacturer warranties, even if offered elsewhere,
(b) may not include service or support options,
(c) may not include user manuals or warnings in your language or the language of the shipping country,
(d) may not comply with the standards, specifications, or labeling requirements of your country, and
(e) may not be compatible with the voltage or electrical standards of your country (an adapter or converter may be required).
It is your responsibility to ensure the product meets your needs and can be legally imported. You accept this responsibility.
TAXES
You are responsible for all taxes, duties, and fees assessed by the jurisdiction to which the products are shipped, including but not limited to sales tax, VAT, or tariffs.
